The short version. Pazau respects intellectual property and expects its customers to do the same. If you believe content on pazau.com, or content a customer hosts on Pazau (such as a help center article or a file sent through the messenger), infringes your copyright, send a notice to our designated agent at copyright@pazau.com. If your content was removed by mistake, you can file a counter-notice. We terminate repeat infringers.
Scope
This policy applies to:
- Pazau's own websites, including pazau.com, docs.pazau.com, and status.pazau.com (the "Sites");
- Content hosted on the Pazau platform by our customers, such as knowledge base and help center articles, macros, attachments, and files sent through the Pazau messenger ("Customer Content").
Pazau responds to notices of alleged infringement under the U.S. Digital Millennium Copyright Act, 17 U.S.C. § 512 (the "DMCA"), and handles notices under the EU Digital Services Act (Regulation (EU) 2022/2065) and other applicable laws as described below.
Customer Content belongs to and is controlled by our customers. Where practical, we'll forward a notice about Customer Content to the customer responsible so they can address it directly. We may also act on it ourselves as described here.
How to submit a DMCA notice
Send a written notice to our designated copyright agent that includes:
- your physical or electronic signature, or that of a person authorized to act on behalf of the copyright owner;
- identification of the copyrighted work you claim is infringed, or a representative list if multiple works are involved;
- identification of the material you claim is infringing, with enough information for us to locate it, such as the specific URL;
- your name, mailing address, telephone number, and email address;
- a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
- a statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
Designated agent:
Copyright Agent
Pazau, Inc., Attn: Legal
350 Brannan Street, Suite 400
San Francisco, CA 94107, USA
Email: copyright@pazau.com
Phone: +1 (415) 555-0142
Pazau's designated agent is registered with the U.S. Copyright Office's DMCA Designated Agent Directory.
Notices that don't substantially comply with these requirements may not be acted on. Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees. Consider whether fair use or another exception applies before you submit.
What happens after a notice
When we receive a valid notice, we will:
- acknowledge it within 2 business days;
- remove or disable access to the material, or, for Customer Content, forward the notice to the customer and require them to address it within 5 business days, after which we may disable access ourselves;
- notify the person who posted the material and give them a copy of the notice, which may include your contact details;
- record the notice for purposes of our repeat infringer policy.
We may forward notices to Lumen (lumendatabase.org), a project that collects and analyzes takedown notices, with personal contact details redacted.
How to submit a counter-notice
If you believe material was removed by mistake or misidentification, you can send a counter-notice to our designated agent that includes:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before removal;
- a statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;
- your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if you are outside the United States, any judicial district in which Pazau may be found), and that you will accept service of process from the person who submitted the original notice or their agent.
When we receive a valid counter-notice, we'll send a copy to the original complainant. Unless they tell us within 10 business days that they have filed a court action seeking to restrain the alleged infringement, we'll restore the material within 10 to 14 business days after receiving the counter-notice.
Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. A user who is the subject of three valid, uncontested notices within 12 months is presumed to be a repeat infringer. For customer workspaces, we work with the customer's administrators to remove individual users and may suspend the workspace under the Subscription Agreement and Acceptable Use Policy.
Notices under the EU Digital Services Act
If you are in the EU, you can report content on the Sites or Customer Content that you believe is illegal, including copyright infringement, by emailing copyright@pazau.com (for intellectual property) or legal@pazau.com (for other illegal content). Include:
- a substantiated explanation of why you consider the content illegal;
- the exact URL or other location of the content;
- your name and email address (unless the report concerns child sexual abuse material);
- a statement confirming your good faith belief that the report is accurate and complete.
We process notices diligently and objectively and tell you our decision and any available redress. Where we remove or restrict content, we give the affected user a statement of reasons. Our single point of contact for authorities and users under Articles 11 and 12 of the DSA is legal@pazau.com, in English. Our EU establishment is Pazau Ireland Limited, 14 Hanover Quay, Dublin 2, D02 X5C4, Ireland.
